Floor Installation Terms and Conditions
GENERAL
In these conditions, the company's (James Airey Flooring) payment terms for account customers are strictly 30 days from the end of the month in which the invoice is issued by the company. Non-account customers: payment on the day of the work; notification of any disputes must be made in writing within 7 days of the invoice date. The company reserves the right to refuse to execute any order if the arrangements for payment or the customer’s credit are not satisfactory to them and to suspend or discontinue the company’s service to any customer whose account is overdue for payment.
Description of goods:
Data in brochures, catalogues, advertisements, websites, or any other information source shall be deemed to be approximate only, unless specifically confirmed in writing by the company. The Company reserves the right to alter the specification of any goods without prior reference to the Purchases, provided that the goods comply in all known respects with the Purchasers requirements.
TITLE TO THE GOODS:
The ownership of the goods shall, notwithstanding delivery to the purchaser, remain in the company until the purchaser has paid the full price to the company. If at any time payment of the price is overdue, the company may, by its servants or agents, enter upon the purchaser’s premises or relevant site premises and recover and dispose of the goods, and the purchaser shall make no claim against the company in respect of such entry or disposal.
DEPOSIT & PAYMENT:
50% of the total payable on the sales order is due at the time of order. A sales invoice will be issued upon completion of work, and balances payable within seven days are open for acceptance within a period of 21 days. I need value for work carried out within three months of the quantity quotation date. We accept payment by cash, check, or bank transfer. Once the customer has paid the deposit, this is seen as accepting our terms and conditions.
VAT NEW BUILDS:
HM Customs and Excise declare that fixed floor coverings for new builds are VAT exempt. James Airey Flooring must receive written confirmation of new build status prior to the commencement of work. If no paperwork has been received prior to the start of the installation, then the sales invoice will be issued with VAT included. It is then solely the responsibility of the customer to reclaim the VAT from HMCE.
CONDITION OF FLOORS:
A survey of all floors will be undertaken by James Airey Flooring prior to the commencement of work. However, unforeseen problems with existing subfloors that ultimately require additional work to enable floor coverings to be installed will incur an additional charge. Damp-proof membranes or moisture vapour suppressants are not always included or stated in the initial quotation. If either of these are required, then the customer will be informed, and this will incur additional charges. No responsibility will be accepted by James Airey Flooring if it is independently proven to be an issue with a faulty subfloor.
SUB FLOOR FINISH:
There is no guarantee or warranty given that cracks will not appear in subfloor screeds and concrete when first laid or in the future; however, any cracks or curling that are evident in a new subfloor after my quotation (James Airey Flooring) has been accepted will be the responsibility of the builder or main contractor. It is up to the builder or main contractor to repair these prior to our installation. In cooperation with James Airey Flooring, it is the builder or main contractor to check as follows:
Check the suitability of the screed specifications against the BS Code of Practice requirements and seek specialist advice in case of differences. For specialist screeds, make sure product data sheets are read in conjunction with BS8204 and BS8000.
Check that the soundness category specified is suitable for the specified flooring and for the expected traffic and load. Check that the levels of the base substrate are suitable for achieving the specified minimum or maximum screed thickness.
Check that any services that need to be incorporated in the screed are adequately detailed and positioned to avoid disruption of the screed at a later stage.
Under Floor Heating Systems:
It is the customer's responsibility to commission the underfloor heating system and be fully aware of the operation of the system so that the floor temperature will not exceed 27°C (80°F) by following the underfloor heating manufacturer's guidelines on heat increase and timing. Checks will be made prior to our installation to ensure that the moisture levels in the subfloor are correct to receive floor coverings. Any resilient floor is suitable for installing over-the-floor heating systems, provided they have been insulated so that the surface temperature does not exceed 27 °C (80 °F). It is your responsibility to make sure that the floor temperature does not exceed 27°C (80°F) once the floor coverings by James Airey Flooring have been fitted. All water-fed and electric underfloor heating systems have instructions and guidelines on how to operate the system. It is the customer's responsibility to read the manufacturer's information regarding warranty and operation once a kit or floor is installed by James Airey Flooring.
British Standards for Floor Levelling:
In the UK, surface regularity (SR) is controlled by British Standards BS8204-1:2003 and A1:2009. According to these standards, flatness tolerances from the underside of a 2 metre long straight edge laid directly on the screeded floor should not deviate more than 3 mm in high standard floors (SR1), 5 mm in normal standard floors (SR2), and 10 mm in utility standard floors (SR3). Variations in floor flatness are measured with special devices (e.g., a slip gauge) at points of maximum deviation from the straight edge. Assessing surfaces prior to installation by James Airey Flooring is a guide to establishing whether or not the subfloor screeds comply with project specifications. The contractor responsible for the house build is required to meet these standards, and any extra preparation costs will be passed onto them.
FURNITURE / WHITE GOODS / HOUSEHOLD ITEMS / BATHROOMS & TOILETS
It is the sole responsibility of the customer to decide on the fitting method for flooring in bathrooms and toilets. Fitting of flooring around sanitary ware can incur an additional fitting charge due to the extra time required for flooring installation. Flooring can be finished using silicon sealant around sanitary ware. If the sanitaryware is removed for flooring installation, James Airey Flooring cannot be held responsible for any leaks that may occur.
Removal of items like appliances can incur extra costs. This can be quoted at the time of the sales order if this service is required by the customer. It is the sole responsibility of the customer to check the correct installation and plumbing of white goods, electrical goods, or furniture on completion.
James Airey Flooring cannot be held responsible for any leakages caused by machines while moving them. If we are required to move any furniture or white goods, effort will be taken by our staff to ensure they are replaced as before, but we will not be held responsible if an item has been damaged due to the deterioration or age of the item. It is the customer's responsibility to move any antique furniture. The customer must inform the fitters if any item is antique or valuable, and they will not move these items.
While every effort will be taken by James Airey Flooring to ensure no damage will be caused to any personal items, it is the customer’s responsibility to remove any pictures, wall hangings, or ornaments, as James Airey Flooring will not be held responsible for any damage.
James AIREY FLOORING GUARANTEE
James Airey Flooring provides to the client, in addition to any statutory rights that the client may have, a guarantee that the services provided under this contract shall be free from defective or flawed materials or workmanship for a period of 12 months from the completion of the services, notwithstanding that this guarantee shall not apply to:
Defects or flaws that are the result of any misuse, failure to adequately and properly maintain, neglect, or failure to follow instructions or recommendations on the part of the client.
Any defect or flaw that is caused by mechanical or chemical damage (which is not in itself a result of some defect in the workmanship or materials) and that arises after a risk to the property has passed to the client.
The supplier shall, at his sole discretion, determine the manner in which he will satisfy this guarantee, whether by repairing, re-performing, or replacing the services, or by refunding to the client all or part of the monies that have been paid.
Where the client considers that the services are defective upon delivery or performance, he shall notify the supplier of this within days, failing which he shall not be entitled to claim the benefit of this guarantee.
This guarantee shall not become effective until the client has paid James Airey Flooring in full, failing which the client shall not be entitled to claim the benefit of this guarantee.
